Paging Evelyn Beatrice Hall’s Voltaire of the Day: The Supreme Court, in an 8-1 decision, ruled in favor of the Westboro Baptist Church’s right to bring their hateful anti-gay message to military funerals.
Chief Justice John Roberts, in his majority opinion, concluded that “Westboro’s funeral picketing is certainly hurtful and its contribution to public discourse may be negligible, but Westboro addressed matters of public import on public property, in a peaceful manner, in full compliance with the guidance of local officials.”
Justice Samuel Alito, who voted against the ruling, said in his dissent: “I fail to see why actionable speech should be immunized simply because it is interspersed with speech that is protected.”
